Terms of Service Effective date: September 5, 2025

  1. Overview and Acceptance Welcome to The BeautyBell ("The BeautyBell", "we", "us"). These Terms of Service ("Terms") govern your access to and use of our mobile apps and website (the "Services"). By creating an account or using the Services, you agree to these Terms and our Privacy Policy (https://beautybell.app/privacy). If you do not agree, do not use the Services.

  2. Who We Are The BeautyBell is an online marketplace that connects independent beauty service providers ("Artists") with individuals seeking services ("Customers"). We do not provide or perform the services listed on the platform and are not a party to the service contract between Customer and Artist.

  1. Eligibility and Accounts
  • Age: You must be at least 18 years old to use the Services.
  • Sign‑in: We use Google Sign‑In for account creation and login. You must maintain accurate, up‑to‑date information.
  • One account: You may not share your account or create accounts for others without permission.
  • Verification (Artists): We may require KYC/identity verification, interviews, and/or proof of qualifications as allowed by law.
  • Suspension/Termination: We may suspend or terminate accounts for policy violations, suspected fraud, or as required by law or store policies.
  1. Role of the Platform
  • Marketplace only: Artists are independent contractors, not our employees or agents.
  • No warranty of services: We do not guarantee the quality, timing, legality, licensing, or suitability of services performed by Artists.
  • Regulated/medical services: Services requiring professional licenses, medical/clinical care, or otherwise restricted by law are prohibited.
  1. Listings, Bookings, and Performance
  • Listings: Artists are solely responsible for their profiles, prices, descriptions, availability, and compliance with applicable laws/regulations.
  • Booking: A booking request from a Customer and acceptance by an Artist forms a contract between Customer and Artist. The BeautyBell is not a party to that contract.
  • On‑site performance: The service is performed at the agreed location/time. You agree to provide a safe environment and to comply with applicable health, safety, and local regulations.
  • Location: The app may request foreground location "when in use" to support booking and discovery features.
  1. Prohibited Services and Conduct
  • Prohibited services include: illegal activities; dangerous or harmful services; medical/clinical procedures; adult/sexual content; any non‑beauty service unless expressly approved; and any service violating law or platform policy.
  • Prohibited conduct includes: fraud; harassment; discrimination; misuse of the platform; reverse engineering; scraping; interfering with operations; or infringing intellectual property or privacy rights.
  • Enforcement: We may remove content, suspend or terminate accounts, and cooperate with authorities when required.
  1. Prices, Fees, Taxes, and Payment Hold
  • Artist price: The Artist sets a service price ("totalPrice").
  • Platform fee: The BeautyBell applies a 15% platform fee on top of the service price. VAT/PPN of 11% is applied on the platform fee only. Rounding to whole IDR may apply.
  • Customer charge: grandTotal = totalPrice + platform fee + VAT/PPN on the platform fee.
  • Payment hold and release: Payments are processed and temporarily held via our payment partner (Xendit). Unless blocked by an open support ticket or policy, funds are automatically released to the Artist’s Xendit sub‑account approximately 3 hours after the booking end time.
  • Payout fees: Any payout fee charged by Xendit (e.g., IDR 2,500) is borne by the Artist. Amounts are subject to change by Xendit; the current fee shown by Xendit or in‑app applies. The BeautyBell does not deduct additional payout fees.
  • Minimum withdrawal: Artists may only withdraw balances above a threshold (currently IDR 300,000, subject to change). The current threshold is shown in‑app, and we may update thresholds; current rules will be displayed in‑app.
  • Taxes: The BeautyBell declares and remits VAT/PPN on the platform fee. Artists are solely responsible for assessing, collecting, and remitting their own taxes on services.
  1. Payments, Refunds, and Disputes
  • Payments: Processed through Xendit XenPlatform (and integrated payment methods like OVO and DANA). We store only provider tokens/ids, not raw card/wallet PAN.
  • Acceptance/Rejection: If an Artist rejects a booking or fails to respond per policy, the booking may be canceled and Customer refunded.
  • Customer cancellations: Cancellation and refund windows are displayed at booking time; refunds follow that policy and applicable law.
  • Support tickets: If a support ticket is opened for a booking, we may temporarily block automatic payment release via our payment partner until the matter is resolved.
  • Chargebacks/Disputes: Disputes or chargebacks may be handled by Xendit and our support processes. You must cooperate with our requests for information.
  • Admin refunds: We may issue refunds consistent with policy, law, payment‑provider rules, and platform integrity.
  1. Artist Obligations
  • Compliance: Artists must comply with applicable laws and regulations (including licensing where required) and must provide services safely and professionally.
  • Accuracy: Listings, pricing, availability, and credentials must be truthful and up to date.
  • Cancellations and Blacklist: Artists who cancel accepted bookings three (3) times (not necessarily consecutively) may be blacklisted until support reactivation.
  • Payout: Artists must maintain a valid payout method and sub‑account. Any payout fees or bank charges are borne by the Artist.
  1. Customer Obligations
  • Accurate information: Provide accurate booking details, including safe access to the service location.
  • Timeliness: Be present or reachable at the appointment time. No‑shows may be charged according to policy displayed at booking.
  • Conduct: Treat Artists with respect; comply with safety and health guidelines and applicable regulations.
  1. Intellectual Property; User Content
  • Platform IP: The BeautyBell and its licensors own all rights to the platform software, logos, and brand elements.
  • User content: You grant us a worldwide, non‑exclusive, royalty‑free license to use, host, reproduce, modify, adapt, publish, and display content you submit (e.g., profile photos, service images, reviews) solely to operate and promote the Services. You represent you own or have rights to the content you submit and that it does not infringe others’ rights.
  • Reviews: We may display and moderate ratings/reviews. We may remove reviews that violate these Terms or applicable law.
  1. Safety and Moderation
  • We may implement safety checks, verification, and moderation measures. We do not guarantee prevention of all misconduct.
  • We may suspend accounts, withhold payment release, or take other action if we suspect fraud, abuse, or violations of these Terms or law.
  1. Third‑Party Services
  • Payment processing and wallets are provided by Xendit and e‑wallet partners (e.g., OVO, DANA) subject to their terms.
  • Push notifications use APNs/FCM/Expo. Maps use Google Maps SDK.
  • Your use of third‑party services is subject to their terms and privacy notices.
  1. Disclaimers
  • As‑is service: The Services are provided "as is" and "as available." We disclaim all warranties to the maximum extent permitted by law.
  • Marketplace: We do not control or guarantee services performed by Artists and are not responsible for acts or omissions of Artists or Customers.
  1. Limitation of Liability To the maximum extent permitted by law, The BeautyBell and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or revenues, arising from or related to the Services. Our aggregate liability to you for any claims relating to the Services shall not exceed the amounts paid or payable by you to us for platform fees in the 6 months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations; in that case, those limitations apply to the maximum extent allowed.

  2. Indemnity You agree to defend, indemnify, and hold harmless The BeautyBell and its affiliates from and against all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your user content; (c) your violation of these Terms or applicable law; or (d) your interactions and agreements with other users.

  3. Changes to the Services or Terms We may update the Services and these Terms from time to time. We will post changes and update the "Effective date." Where required by law, we will provide notice or request consent. Your continued use after the effective date constitutes acceptance of the updated Terms.

  4. Termination You may stop using the Services at any time. We may suspend or terminate your access for policy or legal reasons. Upon termination, provisions that by their nature should survive (e.g., IP, indemnity, limitation of liability, payment obligations) will survive.

  5. Governing Law and Dispute Resolution These Terms are governed by the laws of Indonesia. You agree to the exclusive jurisdiction and venue of the courts located in Jakarta, Indonesia, for any disputes arising out of or relating to the Services, except where another forum is mandated by law.

  6. Miscellaneous

  • Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us.
  • Severability: If any provision is held invalid, the remaining provisions remain in effect.
  • Assignment: You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, or asset transfer.
  • Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control.
  • Electronic notices: You consent to receiving notices electronically.
